1. Acceptance of Terms
By using ArtinLeap’s services, you agree to comply with:
- EU AI Act (2024): Articles 5 (Prohibited AI Practices), 52 (Transparency Obligations).
- GDPR: Articles 5-21 (Data Subject Rights), 25 (Data Protection by Design).
- USA: CCPA (California Consumer Privacy Act), FTC Guidelines on AI (15 U.S.C. § 45).
- Global: ISO/IEC 42001 (AI Governance), OECD AI Principles.
2. Scope of Services
ArtinLeap offers non-high-risk AI solutions classified under EU AI Act, Article 52.1 (“limited-risk” AI systems) and Article 69 (“minimal-risk” AI systems):
- Conversational AI: Compliant with Article 52.1 (transparency obligations via clear user disclosures).
- Agentic Workflows: Under Article 69 (no mandatory conformity assessments).
- AI Education & Strategy: Governed by EU Guidelines for Trustworthy AI (2019).
- Services are updated quarterly to align with EU/US regulatory revisions.
3. User Conduct
Prohibited Uses (Art. 5 EU AI Act):
- Deploying AI for social scoring (Article 5.1(b)).
- Exploiting vulnerabilities tied to age/disability (Article 5.1(d)).
- Real-time remote biometric identification in public spaces (Article 5.1(d)).
USA Users:
- Do not train AI models using health data without HIPAA compliance (45 CFR Part 164).
- Avoid deceptive AI practices violating FTC Act (15 U.S.C. § 45).
4. Data Privacy and Security
EU Compliance (GDPR):
- Lawful Basis (Art. 6): Data is processed under consent, contract, or legitimate interest.
- Data Rights (Art. 15-21): Access, rectify, or erase personal data via our [Data Request Portal].
- Breach Notification (Art. 33/34): Report incidents to ArtinLeap within 72 hours.
USA Compliance:
- CCPA (Cal. Civ. Code § 1798.100-1798.199): Opt-out of data sales via [Preference Center].
- VCDPA (Virginia): No discrimination for exercising consumer rights (Code § 59.1-577).
Global Minimums:
- ISO/IEC 27001: Encrypted storage, annual SOC 2 audits.
- Children’s Data: COPPA (USA) and GDPR Art. 8 (age 16+) compliance.
5. AI Ethics
EU AI Act (2024):
- Transparency (Art. 52): Users receive clear notice before AI interactions (e.g., “This is an AI-generated recommendation”).
- Technical Documentation (Art. 11): Available upon request for auditing purposes (simplified for non-high-risk systems).
- Accuracy & Robustness (Art. 15): Regular testing for bias mitigation.
US Transparency:
- FTC Guidelines: Disclose AI use in marketing (e.g., chatbots, synthetic media).
Generative AI:
- Watermarked outputs where feasible per EU AI Act, Article 52.3(b).
6. Intellectual Property
- AI Outputs: Users must label content created with AI tools (e.g., “Generated with AI assistance”) per EU AI Act, Recital 47.
- Proprietary Rights: ArtinLeap retains ownership of algorithms, datasets, and workflows.
7. Disclaimer of Warranties
- EU Compliance: AI systems meet GDPR (Art. 25) “privacy by design” and EU AI Act (Art. 16) risk management requirements but are provided “as is.”
- No Guarantee: AI outputs are probabilistic and may contain inaccuracies.
8. Limitation of Liability
ArtinLeap is not liable for:
- Damages from violations of EU AI Act, Art. 5 (user misconduct).
- Third-party software or plugins (e.g., CRM/ERP integrations).
- GDPR Fines: Users indemnify ArtinLeap against penalties from unauthorized data processing (Art. 82).
9. Indemnification
You agree to defend ArtinLeap against claims arising from:
- EU AI Act: Breach of prohibited practices (Art. 5) or transparency rules (Art. 52).
- US Law: Violations of CCPA (Cal. Civ. Code § 1798.150) or deceptive AI practices.
10. Governing Law & Disputes
- EU Users: Governed by French law, with disputes resolved under EU AI Act (Art. 74) and GDPR.
- USA Users: Delaware law (if applicable), adhering to FTC and state consumer guidelines.
- Global: ISO/IEC 42001 (AI governance) and UN Guiding Principles on Business & Human Rights.
11. Severability
If any clause conflicts with EU AI Act (Art. 1-85) or GDPR (Art. 1-99), only the invalid portion is severed.
12. Modifications
Terms are updated biannually to reflect EU/US regulatory changes (e.g., EU AI Act Implementing Acts).
